Can I make a claim?

We understand that every cycle accident is different, so to help you understand whether you can make a claim, we’ll provide you with a free, no obligation initial consultation and legal advice to determine how best to proceed.

If you’re unfortunate enough to suffer any injury it is vital you are properly recompensed to cover the damage, and any further treatment or rehabilitation necessary.

There are a few steps that need to be taken to help us determine your case, including evidence gathering and assessment of financial loss which all help us get your claim started.

Many of our cycle claims are funded by a ‘No Win No Fee’ agreement, or ‘Conditional Fee Agreement’ , which means there is no financial risk to you.

An After the Event Insurance (ATE) Policy can also be purchased to protect against any costs payable to third parties that can not be recovered.

Under the terms of  the ‘No Win, No Fee’ or ‘Conditional Fee’ agreement, we agree not to charge you for our fees until your case has settled. If your claim is successful, most of our fees will be paid for by the Defendant. In the event that your case is unsuccessful, we do not charge you our fees.

Other than providing some information and evidence regarding your claim,  which we detail a little more the section ‘The Claims Journey’ , we’ll take care of the process for you.

How long does it take?

We get asked this question regularly but unfortunately it’s impossible to give a specific time scale for settlement; each claim is considered on its own merits.
As a general guideline straightforward cases can settle within 3 to 6 months. However, it’s not sensible to settle a claim until you are confident that you are fully recovered or have considered any permanent restrictions or problems you may face.

The Claims Journey

Although we can’t give a specific timeframe, we can advise you of the steps we take on your journey to settlement.

Step One

If you have been injured, you should seek medical attention immediately. Once your injuries have been sufficiently treated, you should (if possible) gather as much evidence as possible, this includes:
  • Photographic evidence of the accident scene
  • Your injuries
  • Any clothing or kit/equipment damaged in the accident
  • Record the date and time
  • Obtain the details of any witnesses.
  • Obtain the details of the person(s) who caused the accident.

Step Two

After the evidence of the incident has been gathered the next step is to instruct one of our dedicated cycle claim specialist solicitors.
We’ll then provide free legal advice to ascertain whether you have a claim.
After the initial chat we will then proceed to comprehensively explore the evidence of your incident including photos of the scene, damage to clothing, kit and witness details for us to follow up.

Step Three

We’ll  assess any financial loss you have suffered as a result due to damage of your bike and equipment, as well as any for any medical treatment and loss of earnings.
This will allow us to get your claim started against the person or organisation responsible for the accident

Step Four

To fully establish how much compensation you should receive for any injuries sustained following a cycle accident, we’ll obtain your medical records before referring you to one of our trusted independent medical professionals and organise the right specialist to assess you depending on how severe or unique your injuries are.
If you’ve suffered any cuts, bruising or other types of wound it may be helpful to keep record of these to show your doctor as the assessment may not take place until for some time after the accident.

Step Five

Following the examination, the doctor will prepare a report that details how long they expect it to take you to recover, as well as any further treatment needed to aid you in your recovery.
The amount of cycle accident compensation for this part of your claim will be calculated taking into consideration how long the doctor believes it will take you to recover, whether there will be any long lasting or permanent injuries, disabilities or scarring, and whether you need further medical treatment.

Settlement

If the defendant in your claim accepts responsibility they will make a settlement offer which you can choose to accept. Our team will always guide you in this so you know you are receiving the compensation that you deserve.

If the defendant does not accept liability or if choose to decline their settlement offer, we’ll work with you to negotiate a settlement that you are happy with.

In most cases it isn’t necessary to attend court, however, in the event that it is required we’ll guide you through the entire process so you’ll always know what to expect.
